By accessing or using ClearMyPTE (operated by Osborne Education And Migration Pvt Ltd), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

ClearMyPTE is an AI-powered PTE Academic exam preparation platform that provides practice questions, mock exams, AI-based scoring and feedback, progress tracking, and related educational services. Our services are available through web browsers and may include both free and paid subscription tiers.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years of age to use this service.
• One person may not maintain more than one account.
• You are responsible for all activities that occur under your account.

4. Subscriptions and Payments

• Some features require a paid subscription. Pricing is displayed on our pricing page.
• Payments are processed securely through our payment partners (Razorpay).
• Subscriptions are billed according to the plan you select (monthly, quarterly, or as specified).
• Free plan users may upgrade to a paid subscription at any time. No automatic conversion or charges apply.
• All prices are listed in Indian Rupees (INR) unless otherwise stated, and are inclusive of applicable taxes.

5. Refund Policy

Refund requests may be submitted within 7 days of purchase if you have not used more than 10% of the subscribed services. Refunds are processed at our discretion and will be credited back to the original payment method within 7-10 business days.

6. Acceptable Use

You agree not to:

• Share your account credentials with others or allow multiple people to use a single account.
• Copy, distribute, or reproduce any content from the platform without written permission.
• Use automated tools, bots, or scripts to access the platform.
• Attempt to reverse-engineer, decompile, or hack any part of the service.
• Use the platform for any unlawful purpose or in violation of any applicable laws.
• Harass, abuse, or harm other users of the platform.

7. Intellectual Property

All content on ClearMyPTE, including but not limited to practice questions, mock exams, scoring algorithms, AI models, text, graphics, logos, and software, is the property of Osborne Education And Migration Pvt Ltd and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

8. AI Scoring Disclaimer

Our AI-powered scoring is designed to approximate PTE Academic scoring criteria but is not affiliated with or endorsed by Pearson Education. Scores provided are for practice purposes only and may not exactly reflect actual PTE exam results. We do not guarantee any specific score improvement or exam outcome.

9. Institute Accounts

Institutes using our platform for student management agree to ensure their students comply with these terms. Institute administrators are responsible for managing their student accounts and ensuring accurate information is maintained. Institute subscriptions are governed by separate terms as agreed during onboarding.

10. Limitation of Liability

ClearMyPTE is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. You may also delete your account at any time by contacting our support team. Upon termination, your right to use the service will immediately cease.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Punjab, India.
